DRAFT GENERAL LAWS (ANTI‑MONEY LAUNDERING AND COMBATING TERRORISM FINANCING) AMENDMENT BILL, 2025

 

National Treasury has published the Draft General Laws (Anti Money Laundering and Combating Terrorism Financing) Amendment Bill, 2025 for public comment, as announced in Government Notice.

The Bill seeks, among others to:

  • Strengthen South Africa’s AML/CFT system ahead of the next FATF Mutual Evaluation (2026–2027).
  • Expand the FIC’s information‑sharing powers, including the ability to conduct and utilise lifestyle audits.
  • Introduce enhanced compliance, monitoring, and enforcement mechanisms for NPOs.
  • Amend the Companies Act to strengthen beneficial ownership compliance and introduce additional administrative sanctions.
  • Amend the FSR Act to close regulatory gaps relating to financial products/services, licensing, and supervisory powers.

DRAFT TRADITIONAL COURTS REGULATIONS AND CODE OF CONDUCT

The Department of Justice and Constitutional Development has published the draft Traditional Courts Regulations issued in terms of section 17 of the Traditional Courts Act, 2022 and the draft Code of Conduct issued in terms of section 16 of the Act for public comment.

Members of the legal profession are invited to make comments on the Bill for onward submission to the Department of Justice and Constitutional Development. A copy of the Bill can be accessed here.

CALL FOR COMMENTS ON THE DRAFT AMENDMENTS TO THE GAUTENG LIQUOR REGULATIONS, 2004

The Gauteng MEC for Finance and Economic Development has published draft amendments to the Gauteng Liquor Regulations, 2004, as contained in Provincial Notice 2 of 2026.

The draft amendments include, among others:

  • Revisions to fees for applications, issuance, renewals, transfer, and other processes relating to various liquor licences.
  • Updated fee schedules across licence categories such as hotel, restaurant, night club, gaming premises, pub, tavern, theatre, liquor store, sorghum beer, micro-manufacturer, grocers’ wine licences, and other discretionary licences.
  • Amendments to charges for administrative services such as copies of licences, inspector’s reports, minutes of Board proceedings, and duplicate licences.
