DEPARTMENT OF HOME AFFAIRS IMMIGRATION DIRECTIVE NO. 22 OF 2025 – EXTENSION OF TEMPORARY CONCESSION

The legal profession is hereby advised of the extension of the temporary concession granted by the Department of Home Affairs, as encapsulated in Directive No. 22 of 2025. The previously issued Directive No. 4 of 2025 granted a temporary concession, until 30 September 2025, to foreign nationals awaiting the outcomes on their applications for waiver and long-term visa or permanent residence appeals and having an impact on visa and permit applications.

The Department of Home Affairs has since issued a Circular granting the identified group of foreign nationals a further temporary extension until 31 March 2026 to enable the Department of Home Affairs to process the waiver applications, and appeal applications for visa or permanent residence.

The Circular clearly stipulates the manner in which the identified and impacted category of foreign nationals must depart from and re-enter the Republic of South Africa, pending the finalisation of their applications by the Department of Home Affairs and it further states that the concession is applicable to foreign nationals who have been legally admitted into the Republic of South Africa.
