The National Executive Committee of the National Association of Democratic Lawyers (NADEL) at its last meeting for 2017 held at the Garden Court OR Tambo International Hotel approved the plans of the national youth desk to have a national youth summit.
NADEL is perturbed that the key stakeholders of the legal profession failed to take into consideration the views of the youth regarding the Legal Practice Act No 28 of 2014. The Legal Practice Act was drafted with the future in mind. It has aspirations as stated in its preamble of creating a unified profession however we are seriously concerned that the act may have the opposite effect. A fatal error made by all is that they failed to include young people in this process.
It is the young lawyers or young legal practitioners who will be faced with the arduous task of trying to unify a profession that has long been divided. Young people will have the task of destroying those old foundations that created a divided profession that was not representative of our country and that prevented access to justice for everyone. In order for young lawyers to do this they must have a clear understanding of the act. It is up to the young lawyers to learn and engage with leaders and stalwarts in the profession on important aspects of the Legal Practice Act.
We also find it necessary to engage on the important issue of the creation of a professional interest organisation for attorneys. A key issue to be discussed is also the future of professional indemnity cover for attorneys and its increase as an obstacle to young and new professionals starting up practices. It will be an opportunity to engage with the AFF and the AIIF on these issues.
A very serious issue for us is the LLB Degree and professional vocational training thereafter and therefore we will be inviting students, lecturers and law faculties to be a part of our discussions. In order to build a new future we cannot allow teaching and training to be carried out on old paradigms.
With the new impending changes it is imperative for us convene a youth summit. The summit will be inclusive of all young professionals, members of NADEL, BLA and the statutory component.
