|The National Association of Democratic lawyers (NADEL) celebrates the decision of the full bench of the High Court of South Africa, Gauteng Division, Pretoria which dismissed the President of South Africa’s application to review and set aside the remedial action as stated in the “State of Capture Report” of the public protector. The judgment compels the president to appoint a commission of inquiry within 30 days and headed by a judge solely selected by the Chief Justice.
The prima facie findings of the Public Protector are damning to say the least. They allege serious abuse and misuse of power by the president. Such accusations cannot be ignored nor can their investigation be delayed any longer. We call on the President of the republic to timeously comply with the court order and avoid any further delays.
NADEL also welcomes the order that the President pay the costs of the application personally. We believe that this will curtail frivolous and unnecessary litigation not only by the President but by all government officials who abuse court processes to avoid accountability.
We also call on all citizens to respect the decision of the courts and let the law take its course.
