LSSA says RABS Bill, 2017 offends the mores of the public

 

In commenting on the Road Accident Benefit Scheme (RABS) Bill [B17-2017] to the Portfolo Committee on Transport on 29 November 2017, the Law Society of South Africa notes that, in stark contrasts to any other person injured as a result of the negligence of another, a road accident victim is denied reasonable compensation for the damages suffered, is also denied any lump sum payment and is thus denied a financial life line to provide rehabilitation following life changing injuries. In contrast, the negligent motorist is entitled to exactly the same compensation for injuries suffered in an accident caused by his or her own negligence and is completely absolved of any financial responsibility to make good the loss occasioned by that negligence. This offends the mores of the public.
